1 DEFINITIONS 1.1 “Training Center” means Nautilus Pacific Training Center Inc.,. a duly Training Center which cater Filipino seafarers training (STCW 2010 and In-house training) for and in behalf of NPMTCI client. 1.2 "Foreign Principal" means managers and owners of an ocean going vessels employing Filipino seafarers duly accredited and registered In the Philippine Overseas and Employment Administration (POEA) under the NPMTCI Training Center. 1.3 “NPMTCI Client” means ship manager, crew managers and/or Manning agent for and on behalf of the Owner. 1.4 "Owner" the owner of any vessel on which the Seafarer may be assigned from time to time. 1.5 "Personal Data" means any and all information (past, current and future) for and/or in connection with a Seafarer including but not limited to such individual's name(s), photos, telephone number(s), address(es}, email address(es) , family status, passport, professional and/or employment history/track records (including but not limited to any and all CV related data, candidate rating information and video and/or audio interview recordings), ethnic origin, health data, medical records, criminal records, credit history, bank account details, tax records/identification numbers, remuneration details, background checks (including but not limited to personal and/or professional references, criminal record checks, credit scoring/ratings and/or debt collection register information) and any other similar information whatsoever, whether or not available in the public domain and whether or not provided by the individual or was otherwise legally obtained. 2 NOTIFICATION 2.1 I, the undersigned Seafarer hereby acknowledge and confirm that I have carefully read and understood the provisions of the Philippine Data Protection Act of 2002 and its Implementing Rules including the Regulations European Union data protection law in the form of the General Data Protection Regulation, (GDPR) attached hereof and, having done so, I further hereby consent to and without any reservation agree that (i) the NPMTCI Training Center (ii) Foreign Principal (iii) Managers and/or (iv) the Owner and (v) any direct or indirect parent and/or subsidiary and/or associated and/or affiliated company of the NPMTCI Training Center, Foreign Principal, Managers and/or the Owner (hereinafter the "Company• and collectively the "Companies”) may each collect, capture, use, retain, store, structure, retrieve, disseminate, disclose, delete, transfer, cross border transfer, share and/or process my Personal Data for the following purposes: (a) administering my employment, or my application therefor, including with respect to personal and pensions administration, employee management; (b) as required to comply with any laws, regulations or contracts applicable to any of the Companies or their businesses and/or for the exercise or defense of legal claims and/o in accordance with any applicable limitation periods and/or be held in the Companies' records pending threatened and/or commenced legal proceedings and/or challenges; (c) where necessary to protect my vital interests; and 2.2 I understand that my personal data will be stored in the Companies· databases and otherwise processed for the above purposes, in connection with, and during the period of my current period of employment and thereafter for such further period (if any) as is necessary to fulfil the abovementioned purposes. I also understand that the abovementioned processing activities may involve the cross border transfer of my personal data from the Managers to any of the other Companies and/or any other third parties. This may involve the transfer of my personal data to jurisdictions whose data protection laws do not provide equivalent protection to my home country subject to the Companies and/or such other third parties taking appropriate measures to ensure that my personal data is kept secure at all times. To the extent that my personal data includes sensitive personal data, I consent to the Companies processing such sensitive personal data as stated above. I hereby agree to the cross-border transfer of my Personal Data.
